Terms and Conditions

  1. To be eligible to register for the Young Editors Scheme (the “Scheme”) and become a registered user (“Registered User”) you must be aged 18 or over and complete the Registration Form.  There is no charge for registration. A Registered User may be a parent, guardian, teacher, librarian or another person who is responsible for one or more children. Barrington Stoke reserves the right to require proof of age and any other evidence required to prove that these terms and conditions have been fulfilled.

     

  2. By submitting the Registration Form to become a Registered User, you confirm that you have read and understood these terms and conditions and any additional terms and conditions on the Registration Form itself and you agree to comply with them. You agree that logins and passwords are personal to you and that you will keep such details secure and will not share those details with anyone else.

     

  3. Registered Users will be able to download a number of pre-publication manuscripts selected by Barrington Stoke (each a “Manuscript”) from Barrington Stoke’s website solely for the permitted uses expressly permitted under Paragraph 4 below (the “Permitted Use”). Under no circumstances are Registered users permitted to do, nor are they permitted to allow any third party to do, any of the following: 
    1. publish a Manuscript or any part of a Manuscript; 
    2. sell, rent, license or otherwise exploit a Manuscript or any part of a Manuscript, whether on its own or in conjunction with any other work, product or service; 
    3. compile or create any derivative work from a Manuscript or any part of a Manuscript; 
    4. reproduce, copy, distribute, share or otherwise make available a Manuscript or any part of a Manuscript except for the Permitted Uses expressly allowed under Paragraph 4 below;  
    5. disclose the author, illustrator, content, characters, storyline, setting or any other information relating to a Manuscript or any part of a Manuscript, including its existence, except for the Permitted Uses expressly allowed under Paragraph 4 below or with the express prior written consent of Barrington Stoke.

       

  4. Registered Users are allowed to make the following Permitted Uses of each Manuscript only: 
    1. Download the Manuscript and provide copies of that Manuscript to the children for whom that Registered User is responsible (for example the children of a Registered User where that Registered User is a parent or guardian, or the students at the Registered User’s school where the Registered User is a teacher) for the sole purposes of those children giving feedback on that Manuscript as part of the Scheme; 
    2. Read and discuss the Manuscript with the children for whom that Registered User is responsible and for the sole purposes of enabling those children to give feedback on that Manuscript as part of the Scheme; and 
    3. Upload marked up copies of the Manuscript and/or  completed questionnaires to the Barrington Stoke website for the sole purpose of providing feedback on that Manuscript as part of the Scheme.

       

  5. Registered Users are responsible for ensuring compliance with Paragraphs 3 and 4 above by the children for whom that Registered User is responsible.

     

  6. It is anticipated that 2 Manuscripts will be made available per academic term, one for ages up to 12 years old and one for teenagers aged over 12, but the number of Manuscripts that are made available and the age groups for which they are applicable may vary. Each Manuscript will be made available for a limited period of time only, usually for a period of approximately 6 weeks or one academic term. All feedback must be submitted during such time period for the relevant Manuscript. Before a Registered User makes a Manuscript available to children, the Registered User must read that Manuscript and ensure that it is appropriate for those specific children to read.

     

  7. Feedback should be uploaded by Registered Users. It may be given in the form of marked up Manuscripts or completed questionnaires in pdf or word format. Alternatively, Manuscripts and questionnaires may be printed out and marked up or completed by hand and a scan of the final documents may be uploaded to the Barrington Stoke website.

     

  8. Registered Users who have supplied feedback as part of the Scheme may download a printable certificate from the Barrington Stoke website for those children who took part in the Scheme.

     

  9. All feedback uploaded will be available to Barrington Stoke and may be used by Barrington Stoke to inform the final editing process of each Manuscript and the final published book. For the avoidance of doubt, the decision whether or not to publish the Manuscripts or to include any of the feedback in the final books is in Barrington Stoke’s sole discretion.

     

  10. All copyright and other rights in the original Manuscripts are reserved to and shall remain the property of Barrington Stoke or the authors and illustrators of the original Manuscripts, as the case may be, at all times. Those providing feedback under the Scheme shall acquire no rights in the Manuscripts or the final published books or in any materials relating thereto and all rights in any additions and alterations made as a result of the Scheme shall automatically and irrevocably be assigned to Barrington Stoke with full title guarantee and to the fullest extent possible in all languages, forms and media throughout the world in perpetuity. The Registered Users on behalf of themselves and any children who took part in the Scheme hereby irrevocably waive to the fullest extent possible any and all moral rights to which any of them may become entitled in the Manuscripts, the final books and any additions, alterations and materials relating thereto.

     

  11. Barrington Stoke reserves the right to reject applications to become a Registered User and to remove or suspend the account and access of any Registered User at any time in Barrington Stoke’s sole discretion. Barrington Stoke also reserves the right to cancel or suspend the Scheme at any time in its sole discretion.

     

  12. To the extent permitted by applicable law, Barrington Stoke shall not be liable for any damage computer systems or loss of data caused by or arising as a result of downloading a Manuscript or questionnaire or any other material downloaded from the Barrington Stoke website or for any other liability under or in connection with these terms and conditions or the Scheme.

     

  13. These terms and conditions may be updated by Barrington Stoke from time to time and Registered Users are recommended to bookmark and review these regularly. These terms and conditions are governed by Scottish Law and are subject to the jurisdiction of the Scottish Courts.
